Have you been faced with the death of a family member and uncertain of how to proceed with their estate. At Saba Lawyers we can assist you with an Application to the Supreme Court of NSW for Probate or Letters of Administration. If the deceased has left a valid Will, an application for Probate can be made however, if no valid Will exists, an application for Letters of Administration has to be made.


In the event where no Will is left by the deceased the legislation governs on how an estate may be distributed. On the other hand if a Will is left by the deceased, it is a requirement that an executor be appointed to administer the Will upon the death of the person.


Upon the Supreme Court of New South Wales granting Probate, the executor is then authorised to administer the estate of the deceased in accordance with the Will.
